Watching this case develop in then news lately almost restores your faith in the system.
Buffalo cold case detectives
actively lobbied for this woman's release after they learned that her x boy
friend is probably a killer if not a serial in other cases.
The original judge D'Amico
heard arguments from DeJac's lawyers and set aside the charges, the
community of WNY
supported all of this.
The mere fact that her x-boy friend is charged with murder in other cases cast enough doubt that you could never convince anyone that a woman killed her daughter or had any part in her killing and while she was sitting in jail her x boy friend was out killing woman.
If the
Erie
County distinct attorney can't let go of a case where even if he retried
the case and the DA won, DeJac would only most likely face no more time than
she already served and its obvious that this is the outcome, it becomes
obvious that the
district attorney office doesn't believe in justice or convicting the
person that committed the crime, all they believe in is there conviction
rate.
The district attorney says that he has a duty to prosecute this case because the old grand jury charges are there no matter what the money or out come.
This is complete nonsense. We all know that selective enforcement is the norm and not the exception to the rule. Police have the discretion to stop or not stop people committing crimes, speeding, illegal turns and smart cops use selective enforcement of violations observed to pull over and look for major crimes.
In some jurisdictions judges refuse to try any case that speeders are going less that 11 miles over the speed limit, and if cops pull you over for driving 1-10mph over and don't find drugs or drinking and right you a ticket that cops will be on that judges shit list.
Heck prosecutors regularly dispose of cases, drop charges recommend ACD's, or plea cases down that are winnable with minimum prosecution time involvement. Judges even have the option of setting aside convictions if they think the burden of proof hasn't been met.
This DA is sending the wrong message, to be this inflexible when it comes to public corruption or corrupt cops, corrupt government sends the right message, but with the systemic ingraining of corruption at an institutional level in WNY this has not been the case. This short of corruption can only exist because the DA hasn't prosecuted this short of corruption to the maximum penalty allowed by law and has sent the message that public corruption is ok and you get a slap on the hand in these matters, but date a serial killer and get duped by him or her and they end up killing your son or daughter you go to jail for 13 years and then when we let you out because it looks like you dated a murderer and aren't a murderer, we are still going to demand you are retried because we can't have people getting duped into dating serial killers.
If you want to make a point charge Dejac with endangering the welfare of a minor, child abuse and child neglect for using drugs and being an addict and bringing another drug using and possible dealing and abusive man into her house resulting in the murder of her daughter or offer Dejac these charges in a plea bargain for time served. Nobody would be on DeJac's side if she refused this plea and it sends the message that bringing drugs and drug users into your household that has children in it won't be tolerated! This way Dejac can't come back and sue for false imprisonment or damages, because it would be part of the plea agreement.
It's like
the Duke rape case over again, learn from that disgraced DA and don't
beat a dead horse especially one that's infected with disease that will
spread to and infect you while beating that carcass and becomes the
beginning of the end of your public office.
55 year old Dennis Donohue of Kenmore is
arrested for Murder and it turns out that
someone else may be in Jail for a murder he
committed. (WIVB TV) and he might have committed
other murders each one on his birthday.
The other case was
Anthony
Capozzi being locked up in jail for 22 yrs for 3 Rapes he didn't commit
because the victims identified him as the one that attacked them
until cleared by Sanchez's
DNA. I am going to
add that I think it takes a lot of guts by the
Buffalo
NY Police to go back
and examine cold cases and look for justice.
